    If there are assets such a POD (payable on death) checking accounts, TOD (transfer on death) affixed to deeds/titles, and other funds with beneficiaries such as IRAs, my understanding is that those would be distributed before any probate settlements are done. This seems like a good way to funnel high value assets to heirs skirting probate. l

    What if the person dies intestate, and nobody is assigned as an Administrator? Dual ownership of the checking account means my brother has all her existing funds (not much). I helped him get her car assigned to him by the probate court, (without applying to be an administrator). Now, all the credit cards companies are sending collection agency letters to my home. There is no estate nor any funds. Can I tell the collectors to go pound sand?

    In Maryland, each county has a Register of Wills, which is part of the Orphan's Court and handles probate. The Register of Wills keeps wills on file. I don't know if lawyers are required to file wills with the RoW but it is best to see if your local probate court does the same.

    By the time my last grandmother died, my parents and all my other grandparents (I had 3 grandmothers) had died. All in the short span of about 3 years. Every elder had had a will - nothing had been left to chance. You’d think it would have been seamless. But to us, suddenly, generations of property, businesses, and other assets fell into my brother’s, cousin’s, and my laps. Despite a solid 9-year marriage, a great career in technology, my first baby (whom was born hours after my dad passed), and a rock-hard constitution ‘living the dream,’ I reached my wit’s end. One nefarious cousin kept challenging my grandmother’s will (which wisely had put his share in a titered trust), and even charged my father (second only to my husband as best friend) posthumously with undue influence. For NINE YEARS the cousin threw every frivolous charge in the book at the estate in court, fought every step along the way, and did all he could to delay its resolution. Each time, all the properties had to be re-assessed for market value. We all finally paid him off to go away. Too, I literally sold my share of a very large lakeview property to my brother for $1.00, just to escape the madness and resume the important and wonderful life I knew I had to build for my child. The day the estate was finalized, I sent my lawyer’s office a dozen roses. And exhaled. In the 30 years since, I’m still not over it. In the decades of reflection since, I realize my elders loved us all ‘till the cows came home. My immediate family in particular carried and built upon tradition, and embraced them all, not only day-to-day but important holidays. Deservingly or not, we children had been their points of light. Their greatest and final hopes were that, somehow, we’d magically coalesce around a common goodness that embraced their legacy, and carry it forward to our own. Sadly, the reality is their passings revealed disparate expectations, manipulation, and greed. My point? When people craft their wills, they should understand that the adult children they know, love, and leave behind are statistically exactly all they will ever be. For better or worse. They’ll be as financially responsible and rise. Or not. Or be self-motivated to build their futures. Or not. Or find an entity greater than themselves and let it be their beacon to greatness. Or not. Or understand the greatest humanity of all - family. Or not. Will writers shouldn’t hope, let alone expect, people whom have rejected their values to suddenly adopt them in their absence. They never do.

    I recently was the executor for my mother's estate and most of it went reasonably well, but one thing that blindsided me was that within 12 hours of my mother's passing, all her financial accounts were frozen and a couple of them were no longer visible online. What saved me was that I already was managing her finances, so I knew the account numbers and how much was in each account. So I was able to contact the accounts and send them the documentation needed to free the assets. But if I didn't have written records of all those financial accounts BEFORE my mother's passing, I don't know if we ever would have retrieved that money. So do your heirs a favor and have an accurate complete list of all your financial assets saved with your will or somewhere that your heirs can easily find it. That list should include the name and contact information of the financial company, the account #, the name on the account, and the approximate balance in the account.

    Leave any major assets with a beneficiary. That way it's no mistake. The beneficiaries will follow deceased wishes only, not what everyone else wants and probably were established before the person passed away.

    The more I know about this the more I appreciate that you get what you pay for. Get an estate planner and expect to fork over 5k and avoid the problems associated with all this mess.

    What if I do not want my IRAs or life insurance go to my child because he has disability and would not know how to manage a large lump sum? Should the revocable living trust be named as beneficiary and in the trust there are instructions to the trustee to distribute the fund from the IRAs and the life insurance in a set amount annually?

    Keep it simple is best. Leaving someone $1 is the FU from the grave. I think something that is more complicated is when the heirs are left non equal amounts. There may be good reason for this, but it may add additional complications. A funny UA-cam clip about this is one Rowan Adkinson (Mr. Bean) Reading of Will made in 1985..

    How to leave my debt free estate to my 4 adult children without having to go to a lawyers office. I am severely disabled and my entire estate including house and land, car, tools, furnishings, etc. is valued under about $285,000.

    sorry to pop your bubble but your grandma only lived in two centuries, 19th & 20th. 21st century started January 1st, 2001 because first century started the mythical "day one" of 1 A.D. ... BC and AD were established in 4th century AD i believe... (525 AD) and was off by about 5 years... it was later discovered that Christ was crucified about 28 AD but Bible is clear that Jesus was 33 years old when he arose. (Herod died well before 33AD, but became king very few years before condemning Jesus)

    I have been the executor of three estates. Two of those I did without an attorney. The actual paperwork wasn't all that time consuming. I had to make a number of trips to the Register of the Wills each time. The real work was going through papers and cleaning out the houses for sale. My fellow heirs went through everything with me and put the same amount of work cleaning out the house. I did not take executor compensation as I did not think it would be fair as the other heirs did nearly as much work as I did.

    My father was a Trust Officer for a large bank. He did two things that avoided major issues: He avoided probate by setting up trusts for everything to go into to be distributed to my brother and I, and he set the Bank as Executor.

    One question: WHY is it so difficult? Because the process has not been automated. 1. A Basic online interview could route people to one of 15 tracks. 2. Each track would have hyperlink on legal words for definitions. 3. Each form would have an example, instructions, community feedback. Etc. TurboTax handles complexity. Why can’t a software firm do the same for probate in 50 states?

    A living woman or man is forced to do it his or herself because attorney and lawyers will not give a man or woman a real comprehensive conversation. It’s seen attorney lawyers estate planners have a strange practice of forcing men and woman to identify as the DECEDENT and not giving clear explanation of why they are preparing documents in a certain formats for recording purposes made comprehensive to men women entrust with estate planners is not happening. Purporting the DEBTOR doesn’t exist, the estate in his or her lifetime doesn’t exist, to robbing men and women who labor is being exposed. Human trafficking of men and women with cooperation of estate planners is real! So folks are forced to do it his or herself. 🤬. Like we said, real conversation are NOT happening because breach of trust will happen as soon and the estate planner session happens in the billing process. It’s sad!

    My older brother was executor of my mother’s estate and not only did he procrastinate, he never provided one update to me and my younger brother about the status. I had to contact the attorney and vent my frustration with the progress. It took 2 1/2 years and I no longer speak to him. I never realized what a passive aggressive control freak he is.

    Adult children who cut off their parents shouldn’t get anything. Why should they? I don’t get it. Why would they want anything? Seems if you can’t be understanding of issues that family members have - whether it’s a personality disorder, high anxiety, depression, etc - then why would you want their wealth? That would be sociopathy
